Terms of Use
1. General
Servisa Foundations, St. Alban-Anlage 26, CH-4052 Basel provide their current (and former) insured persons and beneficiaries of the collective foundations (referred to individually as a “User” or collectively as the "Users") with an online platform (at the following URL: https://portal.servisa.ch) for various Servisa services ("insuree portal").
By registering on the insuree portal, the User expressly consents to these Terms of Use, to the privacy statement of the insuree portal in the current version published on the website (available at https://www.servisa.ch/english/data-protection.php), particularly to the transmission and supply of data, even of a sensitive nature (e.g. medical data) as well as to electronic communications to the e-mail address registered by the User.
2. Range of services
In connection with the insuree portal, Servisa offers services for use of the web application, information exchange between the User and Servisa and/or its administrative and partner systems, insertion of various information guides (e.g. online web videos) and any documents, information and user support for the insuree portal ("Range of Services"). The functions and services of the insuree portal are described in detail in the insuree portal itself. The insuree portal can be used free of charge.
Helvetia may expand, restrict, extend, discontinue or change the Range of Services at any time, even if it results in the User losing access to the insuree portal (and certain of its data items). The return of your documents can be demanded at any time.
3. Registration and access data
The insured person must register to use the insuree portal. Registration must follow the instructions on the insuree portal. Servisa may conduct an identity check and may also involve third parties (e.g. identity providers) for this purpose, namely to validate an insured person’s mobile phone number. The insured person is responsible for ensuring that their information is correct and complete. The insured person is obliged to announce changes to the information to be provided during registration. The insured person can view and update these changes in the "Customize personal data" section of the website.
After successful registration, the insured person receives their access data for the insuree portal ("Access data").
Effect of registration: By registering and accepting the Terms of Use, the insured person expressly consents to the electronic delivery of documents such as the insurance certificate, tax certificates, etc., as well as to electronic communication as of receipt of the access data to the insuree portal, provided that they have opted for digital dispatch in the settings. The electronically delivered documents are available as a PDF document in the personal account in the insuree portal and can be downloaded and printed at any time. The receipt of new documents in the insuree portal will be communicated by e-mail.
4. Usage rights and duties of care
a. Of the User
Users must keep their Access Data secret. They are responsible for any use, including misuse, of their Access Data in connection with insuree portal services. The insuree portal is available to Users exclusively for their own use.
Users undertake to use the insuree portal in compliance with the rights of third parties (e.g. copyright and trademark rights), not to violate statutory provisions and not to transmit or create links to any illegal or immoral content.
In case of suspicions that the insuree portal account is being used by an unauthorized third party, the User shall promptly inform Servisa by e-mail or by telephone and have the user account blocked.
Users may request that their access to the insuree portal be blocked, temporarily or permanently.
Users may terminate their use of the insuree portal at any time. Users can deactivate their accounts by deleting their Access Data. Deleting the Access Data will only result in terminating the contractual relationship concerning the insuree portal and will not lead to the termination of any other contractual relationships with Servisa. The termination of other contractual relationships with Servisa does not lead to the termination of the contractual relationship concerning the insuree portal, which Users may continue to use if desired.
From the time of deletion/deactivation of the insuree portal and/or in case of a blockage (even if only temporary), all contract-related documents and declarations will be sent to the policyholder again in writing by post.
Users have the option of opting out of Servisa using their personal data for marketing purposes or the like.
b. Of Servisa
Servisa presumes registered Users to be appropriately authorized. Servisa assumes that all of the User’s queries, orders, actions, instructions, etc. in the insuree portal are actually issued by the identified User. The foregoing is without prejudice to statutory restrictions on legal capacity.
Servisa reserves the right to block a User’s access to the insuree portal without stating any reasons in case of suspicions of improper or fraudulent use of the Portal or if the User violates the present terms and conditions. The blockage of access shall be communicated in writing by e-mail or by post. From the time of blockage (even if only temporary) of the insuree portal, all contract-related documents and declarations shall be sent to the policyholder again in writing by post.
Servisa may use the Access Data or other user data (particularly the User's e-mail address) for marketing purposes, and may also submit offers to the User outside the insuree portal at any time.
5. Correspondence
Servisa may, at the insured person's request, provide the latter with contractually relevant documents such as insurance certificates, benefit announcements, tax certificates, etc., or other correspondence and notifications ("correspondence") exclusively electronically via the insuree portal.
The insured person will be informed in advance in a suitable form – as a rule electronically – if the correspondence is to be provided via the insuree portal. According to this information, the documents and notifications are deemed to have been delivered to the insured person as soon as they are available in the insuree portal. Servisa remains entitled to continue delivering the correspondence by post, in particular if it must be in writing for legal, contractual or evidentiary reasons.
6. Disclaimer of warranty and liability
Helvetia gives no warranties, guarantees and assurances, particular not regarding the insuree portal’s availability, completeness, correctness, or freedom from errors, fitness for purpose or regarding the infringement of any third-party rights (copyrights etc., non-infringement) or other services or for the content of external websites.
The User is required to promptly check the contract-related documents delivered via the insuree portal and to immediately report by e-mail or by telephone any deviation from the contractually agreed statements. Servisa is not liable for accurate transmission of the content of the contract-related documents and contract information delivered via the insuree portal, so long as the relevant error is not caused by Servisa and/or a warning was issued in a timely manner and/or the error was based on the failure of automated data processing.
To the extent permitted by law, Servisa disclaims all liability for any damage caused to the hardware or software of the User or a third party, and for inadequate security or functionality of the hardware and software used or for such damage as may arise from failure to establish the connection with the insuree portal.
Servisa disclaims all liability (including for its bodies, employees and auxiliary persons) to the extent permitted by law. Servisa is liable neither for slight and moderate negligence nor for indirect and consequential damage (loss of profit, third-party claims).
All information, content and related presentation methods, designs and software published in the insuree portal are protected by copyright; the rights thereto belong to Servisa or its licensors.
Any duplication, reproduction, distribution or other commercial use of the information on Servisa's websites or applications is prohibited without the express permission of Servisa. This does not apply to information or data expressly authorized by Servisa for specific purposes (e.g. downloading forms).
7. Data protection and security
By registering on the insuree portal, the User consents to the privacy statement on the online portal in the latest version published on the website. Users expressly consent to their data (including sensitive data such as medical data, etc.) being used on the insurer’s system and stored by third parties commissioned by the insurer and electronically transmitted.
8. Changes to the Terms of Use
Servisa may amend, restrict or extend these Terms of Use in part or in full at any time. The User shall be notified reasonably in advance of any changes to the Terms of Use in a suitable form – usually electronically.
By continuing to use the insuree portal after the effective date of the new Terms of Use, the new Terms of Use shall be deemed to be accepted by the User.
9. Partial nullity
In the event of individual provisions of these Terms of Use proving invalid, in whole or in part, this will not affect the validity of the remaining provisions. In the event of an individual provision proving invalid, the invalid provision will be replaced with another clause which most closely reflects the intended purpose of the clause found to be invalid.
10. Further provisions
In addition to these Terms of Use and the data protection provisions, the legal notices and any other terms and conditions published on Servisa's websites, especially concerning the risks of electronic communication, shall apply.
11. Applicable law and legal venue
These Terms of Use are subject to Swiss law.
For all disputes arising from or in connection with the use of the insuree portal, the courts at the consumer's place of residence or the courts in Basel shall have jurisdiction for actions brought by the consumer. For actions brought by Servisa, the court at the domicile of the defendant shall have jurisdiction.

PDF–Dateien sind im Format Adobe / Acrobat Reader (gratis Download) gespeichert.
